Refund Policy

The Profitpreneur (“we,” “us,” or “our”) operates the Profitpreneur website and related products and services (collectively, the “Service”).

This Refund Policy describes our policies regarding refunds, returns, cancellations, chargebacks, and related matters for purchases made through the Service. By purchasing from or using the Service, you (“you,” “User,” “Customer,” or “Client”) agree to this Refund Policy. If you do not agree with this Refund Policy, please do not purchase.

Definitions

For purposes of this Refund Policy:

  • “Digital Products” means any downloadable or access-based digital content, including (without limitation) courses, trainings, videos, PDFs, templates, scripts, workbooks, toolkits, and other digital materials.

  • “Membership” means any subscription-based access to our portal, training library, community, tools, resources, and/or related membership benefits (including monthly and annual plans).

  • “DFY Services” (“Done-For-You Services”) means any application-based, implementation-based, managed, done-for-you, and/or done-with-you service where we perform work on your behalf, including (without limitation) DFY Business Build Packages (e.g., Gold, Gold Prestige, Platinum) and any related business, marketing, or technology services offered through Profitpreneur and/or ProfitSites, such as website design/build or migration, funnel and landing page builds, automation and workflow setup, CRM setup/configuration and integrations, email marketing setup, forms and surveys, scheduling/booking systems, AI programming, chatbot/AI agent installation, local SEO, database/tagging/segmentation, analytics and tracking setup, reputation/review systems, missed call text back, membership setup/installation/integration, hosting/maintenance, community setup/installation/integration, and any other implementation or support services described on the applicable sales page, proposal, invoice, checkout page, order confirmation, or agreement.

  • “Coaching/Consulting” means any coaching, consulting, strategy sessions, mentoring, audits, intensives, workshops or advisory services delivered live or asynchronously.

  • “Delivered and/or Access is Provided” means (without limitation) when a download link is sent, portal/login credentials are issued, access is activated, onboarding materials are provided, or you are otherwise granted access/entry to paid content, tools, or resources.

Refunds for Digital Products

Because Digital Products are delivered electronically and may be accessed immediately, all sales are final once the digital product is delivered and/or access is provided. We do not offer refunds, returns, or exchanges for Digital Products, except where required by applicable law.

Memberships: Billing, Cancellation, and Refunds

a) Membership Fees Are for Access (Similar to Tuition)

Membership fees are charged for access to education, tools, resources, and community features during the term of your Membership. You are purchasing access to information, training, and tools, not a guaranteed outcome. Results depend on your implementation, consistency, and decision-making. Your decision not to use the Membership, not to log in, to pause participation, or to cancel after purchase does not create a right to a refund. If you are unsure whether the Membership is right for you, please do not purchase.

(b) Auto-Renewal and Recurring Billing

If you purchase a Membership with recurring billing (monthly or annual), your subscription may renew automatically unless canceled in accordance with the instructions provided in your account area and/or purchase confirmation.

(c) Cancellation Stops Future Charges Only

You may cancel at any time to stop future charges. Cancellation generally takes effect at the end of your current billing period, and you will typically retain access through the end of the paid term unless otherwise stated at checkout.

(d) No Prorated Refunds

We do not provide prorated refunds for partial months/terms, unused time, or unused access. All Membership sales are final once Delivered and/or Access is Provided, except where required by applicable law.

DFY Business Build Packages (Done-For-You Services)

DFY Services require reserving capacity, initiating onboarding, allocating project resources, and/or beginning implementation based on your purchase.

(a) Non-Refundable Once Services Begin / Slot Is Reserved

All DFY Services payments are non-refundable once any of the following occurs (each, a “Service Commencement Event”):

  • Your application is accepted and your deposit is paid (if applicable);

  • A build slot is reserved for you (whether by deposit, scheduling, or written confirmation);

  • We provide onboarding/access such as intake forms, project documents, portal access, shared folders, or a project workspace;

  • We begin implementation, configuration, development, programming, installation, integration, migration, or build work of any kind; and/or

  • We purchase, provision, or configure any third-party tools, licenses, domains, hosting, software, or other non-returnable resources on your behalf.

Because DFY Services involve time, labor, and resource allocation that cannot be “returned,” we do not offer refunds, returns, or exchanges for DFY Services, except where required by applicable law.

(b) Client Responsibilities and Timelines

DFY Service timelines depend on timely Client participation, including providing requested content, approvals, brand assets, access credentials, and other inputs. If you do not respond or provide required materials within a reasonable period, your project may be paused and rescheduled based on availability. Pauses do not create a right to a refund.

(c) Scope, Deliverables, and Revisions

Your DFY Services purchase includes only the deliverables, scope, and revision limits stated on the applicable sales page, checkout page, proposal, invoice, order confirmation, and/or agreement. Requests outside the stated scope may require additional fees and/or a separate agreement.

(d) Managed Services / Ongoing Support

If your DFY Services include ongoing support, maintenance, monitoring, hosting, software/tools, or other recurring services, you may cancel to stop future charges in accordance with the cancellation instructions provided. We do not provide prorated refunds for partial months/terms, unused time, or unused services, except where required by applicable law.

Coaching (aka "Mentorship/Mentoring") and Consulting

Coaching/Consulting is a time-based professional service that may include reserved time, preparation, review of materials, and delivery of live and/or asynchronous support.

(a) Non-Refundable Once Reserved / Services Begin

All Coaching/Consulting payments are non-refundable once any of the following occurs (each, a “Coaching Commencement Event”):

  • Your application is accepted and/or your deposit is paid (if applicable);

  • Your session(s) are booked or scheduled (whether by calendar booking, written confirmation, or other scheduling confirmation);

  • We provide onboarding/access such as portal access, intake forms, questionnaires, shared folders, private links, or any materials intended for your participation;

  • We begin preparation, review, analysis, strategy development, or any pre-work related to your Coaching/Consulting purchase; and/or

  • Any Coaching/Consulting services begin, whether delivered live, by message/email, or through asynchronous support.

Because Coaching/Consulting involves reserved time and professional services that cannot be “returned,” we do not offer refunds, returns, or exchanges for Coaching/Consulting purchases, except where required by applicable law.

(b) Rescheduling / Missed Sessions

If rescheduling is offered, the reschedule/cancellation window (if any) will be stated on the applicable sales page, checkout page, booking confirmation, invoice, proposal, order confirmation, and/or agreement. Missed sessions, late arrivals, partial participation, perceived lack of results, or failure to complete requested pre-work do not create a right to a refund.

(c) Payment Plans (If Applicable)

If Coaching/Consulting is purchased on a payment plan, you agree to complete all scheduled payments as agreed. Non-use, non-attendance, or dissatisfaction does not cancel your payment obligation, except where required by applicable law.

Action-Based Implementation Guarantee (If Offered)

From time to time, we may offer a limited Action-Based Implementation Guarantee for specific products, programs, or plans. Any such guarantee applies only if it is explicitly stated on the checkout page or sales page at the time of purchase, and it will be subject to proof-of-implementation requirements and deadlines. If no Action-Based Implementation Guarantee is displayed at checkout for your purchase, no guarantee applies.

Chargebacks and Payment Disputes

If you have a concern about a purchase, you agree to contact us first with a support ticket so we can attempt to resolve the issue.

If a chargeback or payment dispute is filed after the digital product is delivered and/or access is provided, or after any Service Commencement Event (Section 4(a)) and/or any Coaching Commencement Event (Section 5(a)), then:

  • your access to the Service may be suspended or terminated at our discretion while the dispute is investigated; and

  • we will provide purchase records, delivery/access logs, usage records, communications, project records, coaching records, scheduling confirmations, and related documentation to our payment processor and/or financial institution to respond to the dispute.

Friendly Fraud / Chargeback Abuse

A chargeback or payment dispute submitted for a purchase that was validly authorized and for which Digital Products and/or access were delivered (or DFY Services commenced following a Service Commencement Event, and/or Coaching/Consulting commenced following a Coaching Commencement Event) may be legally considered chargeback abuse (“friendly fraud”).

In such cases, we reserve the right to pursue all rights and remedies available under applicable law, including (without limitation): contesting the dispute, recovering amounts owed, recovering any chargeback/dispute fees assessed to us, recovering any legal fees incurred from the process, and seeking additional relief as permitted by law.

Limited Exceptions (Billing Errors)

We may, at our sole discretion, consider refunds only in limited circumstances such as duplicate charges or billing errors caused by us. We may require documentation to investigate and resolve any such issue.

Consumer Rights

Nothing in this Refund Policy is intended to limit any consumer rights that cannot legally be waived under applicable law. Where refunds are required by law, we will comply.

Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service.

Termination does not create a right to a refund.

Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an “AS IS” and “AS AVAILABLE” basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

Governing Law

These Terms shall be governed and construed in accordance with the laws of United States without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service and supersede and replace any prior agreements we might have between us regarding the Service.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 3 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
